This website is operated by the artist and offers original artworks, Fine Art Prints, and additional art products for purchase.
By completing a purchase, the customer agrees to all terms outlined in this policy.
This policy is written in accordance with Israeli consumer protection laws, including all legally permitted exceptions for unique or custom-made artistic products.

1. Use of the Website

1.1 Binding Agreement
These Terms of Use constitute a binding agreement between you — whether as an individual or on behalf of a legal entity (“you”) — and the Website regarding your access to and use of the Website on any device, including desktop computers, mobile phones, tablets, or any other communication device. These Terms also apply to the use of the Website and/or related services through applications or any other digital platform.
By browsing the Website and/or making any purchase, you confirm that you have read, understood, and agreed to be bound by these Terms (“the Terms”).

1.2 Gender-Neutral Language
The Terms apply equally to all genders. Use of masculine, feminine, or neutral pronouns is for convenience only.

1.3 Eligibility to Purchase

Browsing the Website is permitted at any age; however, purchasing through the Website is restricted to individuals aged 18 or older who possess legal capacity. Any purchase made by a minor under 18 requires parental or guardian approval.

As a general rule, browsing and viewing the Website do not require prior registration, and the Website is open to all users.
However, the Website reserves the right, at its sole discretion, to restrict access to certain services or features to unregistered users, for any reason, without prior notice, and without bearing any responsibility for any resulting damages.

If any provision of these Terms is found to be unenforceable or invalid for any reason, this shall not affect the validity or enforceability of the remaining provisions.

2. Intellectual Property

2.1 Ownership of Content and Marks

Unless expressly stated otherwise, all intellectual property rights on the Website — including designs, images, audio, video, text, databases, software, code (the “Content”), as well as icons, trademarks, logos, and similar elements (the “Marks”) — are the exclusive property of the Website or of third parties who have granted the Website appropriate permission or licenses, including business partners.

4.1 User Warranties

The Website shall not be liable to you or to any third party for any modification, suspension, interruption, or discontinuation of the Website or its services.

7.3 No Warranty of Perfect Operation
The Website does not guarantee that its services will operate without interruptions, errors, malfunctions, security breaches, or unauthorized access. Disruptions may occur due to technical issues, third-party factors, infrastructure failures, malicious activity, or circumstances beyond the Website’s control.

7.4 Changes to Terms

The Website reserves the right to update these Terms at any time and without prior notice. Continued use of the Website after such updates shall constitute acceptance of the revised Terms.

8. Prices and Orders on the Website

8.1 Changing Prices and Availability

Product prices, availability, and purchasing conditions listed on the Website may change from time to time without prior notice. The Website may add, modify, discontinue, or remove products or services at its discretion.

8.2 Accuracy of Customer Information

When placing an order, the customer must provide accurate, complete, and up-to-date information. The Website may verify the details provided after an order is submitted and may cancel or restrict an order at its discretion. If payment has already been made for a cancelled order, the payment will be refunded to the original payment method.

8.3 Payment Authorization

If the credit card company or any payment provider refuses to authorize payment for an order, the Website may immediately suspend or discontinue the service. The Website may also charge the customer through alternative payment methods and request reimbursement for any costs incurred due to the refusal (including fees charged by third parties). In the event legal action is required to collect outstanding payments, the customer shall cover all associated expenses, including attorney’s fees.

8.4 Additional Payment Terms

Purchases made on the Website are also subject to the terms and conditions of the credit card companies, payment processors, and any other payment method available on the Website.

9. Shipping & Delivery Policy

9.1 Order Processing Times

Original artworks are typically prepared and shipped within 5–10 business days, unless stated otherwise on the product page.
Fine Art Prints, produced on demand, may require up to 7-10 business days for production before shipping.
Processing times may be extended during holiday periods, promotional events, seasonal delays, or due to external circumstances beyond our control.

“Business Days” refer to Sunday–Thursday, excluding official Israeli holidays, holiday eves, and days when banks do not operate.

9.2 Domestic Delivery (Israel)

The Website will arrange delivery to the address agreed upon during checkout.

Estimated delivery times:

Up to 7 business days for central regions of Israel (courier to home or pickup point).
Up to 14 business days for remote locations (north of Hadera or south of Gedera).
Self-pickup, arranged in advance, is available at no cost from a designated address provided during coordination.

Shipping fees within Israel may vary according to destination, courier rates, package size, or volumetric weight, and will be presented at checkout.

The Website may set a minimum order amount for delivery.

9.3 International Shipping

All international orders are shipped via reputable global couriers.

Shipping costs are calculated at checkout based on:

Destination
Actual or volumetric weight (whichever is higher)
Packaging requirements (e.g., protective cylinders for rolled canvases)

Estimated Delivery Times
Estimated international delivery times are typically up to 30 business days, depending on the destination, customs clearance, and courier handling.

Customs & Import Fees
International shipments may incur customs duties, VAT, import taxes, or handling fees.
These charges vary by country and are the customer’s responsibility.

Delays
Due to the ongoing security situation and regional instability, including the current war, international shipments may experience delays beyond the estimated delivery times. Such delays are beyond the Website’s control and shall not be considered a breach of this policy.

Delays caused by customs authorities, border control, or international courier handling are outside the Website's control and do not constitute a breach of this policy.

9.4 Packaging & Special Handling

Original artworks are packaged with reinforced protection to ensure safe transit.
Fine Art Prints are shipped rolled in durable, moisture-resistant tubes.
Fragile or oversized pieces may require additional handling, reflected automatically in the shipping cost.

9.5 Delivery Conditions

Delivery is subject to the following conditions:

The delivery address must be reasonably accessible.
The Website (or its courier partners) must operate in the specified area.
For institutions, secured facilities, kibbutzim, or localities without orderly street/house numbering, delivery may be made to a central collection point.

If the customer is unavailable at the agreed delivery time, the shipment may be returned and resent at the customer's expense.

If the customer authorizes delivery to be left at the door or with a neighbor, all responsibility for loss or damage after drop-off rests solely with the customer.

9.6 Out-of-Stock Items

If an item becomes unavailable after purchase:

The Website will attempt to contact the customer.
If the customer cannot be reached, the order may be shipped without the unavailable item, and the customer will be refunded for that product.

9.7 Delays and Force Majeure

The Website shall not be liable for any delay, late delivery, or non-delivery caused by:

Force majeure events, including natural disasters, war, strikes, emergencies, or circumstances beyond the Website’s control
Delays or failures on the part of courier companies
Situations affecting national operations, including government restrictions, sector shutdowns, or supply chain disruptions

9.8 Damaged or Lost Shipments

If an item arrives damaged or appears to be lost in transit, the customer must notify the Website within 48 hours and provide:

Clear photos of the damage
Photos of the external packaging
A description of the issue
Order details and tracking number (if provided)

After reviewing the claim, the Website may offer:

Repair
Replacement (when applicable)
Partial or full compensation
or another appropriate solution at its discretion.

Claims submitted after the 48-hour window may not be eligible for compensation.

10. Cancellations, Returns & Refunds

10.1 General Principles

This policy is aligned with Israeli Consumer Protection Law (1981) and its exceptions regarding:

Unique, one-of-a-kind original artworks
Custom-made or personalized items
Print-on-Demand products (Fine Art Prints) created specifically per order

Such items are legally exempt from mandatory returns once production or shipping has begun.

10.2 Cancellation Within 24 Hours

Customers may cancel, modify, or request a refund for an order within 24 hours of purchase, provided production or shipping has not yet begun.

In such cases:

A refund will be issued minus a service fee of 5% or 100₪, whichever is lower.
The refund will be processed to the same payment method used for the original order.

If production, printing, or packaging has already started, the cancellation rules in Sections 10.3–10.4 apply.

10.3 Product-Specific Return Policy

Original Artworks

Original artworks are one-of-a-kind pieces and are exempt from mandatory returns under the law.
Once shipped, all sales are final.
In rare cases of shipping-related damage, a case-by-case solution will be offered.

Fine Art Prints (Print-on-Demand)

These items are produced specifically for each customer and are legally considered custom-made.

Therefore:

Fine Art Prints are non-refundable and non-returnable once production begins or after shipment.
If the item arrives damaged, defective, or incorrect, a replacement print will be issued at no cost, or an alternative solution will be offered.

Custom or Special Orders

Personalized or custom-designed items cannot be canceled or returned once production has started.

If an error is made by the Website or its suppliers, full corrective responsibility will be taken.

10.4 Returns in Cases of Damage or Error

In cases where a return or replacement is approved:

Customer must notify the Website within 48 hours of receiving the item.

Customer must provide:

Photos of the product
Photos of the external packaging
A description of the issue

If the return is due to a product defect, the Website is responsible for arranging pickup or replacement at no additional cost.

Returned products will be inspected by the Website.

If the item is found not defective, or damage is determined to have occurred after delivery due to unreasonable use, no refund will be issued.

The customer may request the item to be sent back to them, subject to additional shipping costs.

Refunds (when approved) will be issued only after the item is received and inspected.

10.5 Customer Responsibility Upon Delivery

Customers must inspect their package immediately upon delivery.

If the package appears damaged, it is recommended to refuse the delivery and request documentation from the courier.

Accepting a damaged package without documentation may limit eligibility for compensation.

10.6 Legal Compliance

This policy is subject to and interpreted in accordance with the Israeli Consumer Protection Law, 1981, including all applicable amendments and regulations.
